1. Who you are contracting with
These Terms form a contract between you and Forkable ("Forkable", "we", "us"). By creating an account or using the Forkable service you agree to these Terms.
2. The service
Forkable provides a community-verified directory, guidance content, recipes and related tools for people managing food allergies and intolerances in the UK. Features may change from time to time as we improve the service.
3. Your account
You must provide accurate information and keep your login credentials confidential. You are responsible for activity that occurs under your account. If you are creating an account on behalf of an organisation, you confirm you have authority to bind that organisation. If you are using Forkable as an individual, you confirm you are of legal age in your country.
4. Acceptable use
You must not misuse the service. In particular, you must not:
- use the service in any unlawful way or for fraudulent or spam purposes;
- infringe intellectual property or privacy rights of Forkable or others;
- attempt to interfere with the security or integrity of the service, including probing, scanning, scraping, or introducing malware;
- reverse engineer, resell, or redistribute the service, or circumvent its technical limits.
5. Intellectual property
Forkable and its licensors retain all rights, title and interest in the service, including its software, content, branding and documentation. We grant you a limited, non-exclusive, non- transferable licence to use the service in accordance with these Terms.
6. User content
You retain ownership of content you submit (for example, venue recommendations or reviews). You grant Forkable a worldwide, royalty-free licence to host, display, moderate and use that content solely to provide and improve the service.
7. Payment, subscription and billing
Paid subscriptions to Forkable are sold and fulfilled by our online reseller Paddle.com, which is the Merchant of Record. Payment, billing, tax, cancellations and refunds are handled by Paddle in accordance with the Paddle Buyer Terms. Subscriptions auto-renew each billing period unless cancelled. You can cancel at any time and will retain access until the end of the paid period.
8. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
9. Service level and disclaimers
The Forkable directory and guidance are provided for information only. Allergen safety ultimately depends on the venue, product and situation, and you should always confirm requirements directly with venues where the risk warrants it. The service is provided on an "as available" basis and we do not guarantee it will be uninterrupted or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for purpose.
10. Liability
To the fullest extent permitted by law, Forkable's aggregate liability for any claim arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the claim. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
11. Indemnity
You agree to indemnify Forkable against claims arising from your user content, your unlawful use of the service, or your breach of these Terms.
12. Suspension and termination
We may suspend or terminate access to the service for material breach of these Terms, non- payment, suspected fraud or security risk, or repeated or serious policy violations. You may close your account at any time. On termination, your right to use the service ends and we may delete your data after a reasonable retention period as described in our Privacy Notice.
13. Changes
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the service after changes take effect constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that you may bring claims in your country of residence where required by local law.
15. Assignment and force majeure
You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delay or failure due to events beyond their reasonable control.
